General Terms of Sale

You must read and agree to these T&Cs in order to enjoy the services we
offer. By booking a stay at one of our campsites, you are deemed to have
unconditionally agreed to these T&Cs at the time you make the booking.
1 – SCOPE
These general terms and conditions of sale (T&Cs) apply unconditionally
and without limitation to the booking of all accommodation rentals
and bare sites (the Accommodation) agreed between the Sea Green
establishments (the Establishments) and the consumer or nonprofessional
(the Customer or Customers) wishing to stay at the
Establishment. Bookings can be made on www.seagreen.fr, on the
Establishments' own websites or by telephone on +33 (0)5 64 10 20 20.
These T&Cs state the terms of rental, booking, payment and stays ordered
by the Customers.
The main features of the Accommodation available to rent are detailed
on the website www.seagreen.fr as well as on the Establishments' own
websites. Photos and drawings shown are not binding and in no way give
rise to any liability on the part of the Establishment. Customers must
refer to the description of each Accommodation option for information
about its key features and attributes.
Accommodation is available for rental subject to availability.
These T&Cs are systematically communicated to each Customer before
they confirm their booking and will prevail over any other version or
contradictory document, when required. The T&Cs can be viewed at any
time on www.seagreen-campings.com as well as on the Establishments'
own websites.
Customers confirm they have read these T&Cs and agree to them before
booking. When Customers confirm their booking, they are deemed to
have agreed to these T&Cs unconditionally and without limitation.
It is explicitly agreed that Customers have no right of withdrawal under
Article L. 222-10 of the French Consumer Code.
2 – ORDERS/BOOKING
Customers go online to select the Accommodation, rental period and
rental terms they want. They can then enter the booking tunnel to make
their booking, in accordance with the Group's deposit policy.
Customers are responsible for checking that their order and the price are
correct, and to make any corrections before confirming their booking.
All bookings made through the aforementioned website constitute a
remote-sale contract between the Establishment and Customer.
Rental accommodation and bare site bookings are only confirmed after:
- the Establishment sends written confirmation
- the deposit, processing fees and cancellation insurance premium (when
selected) are received
- the duly completed and signed booking contract is received or a
confirmation email is received when booking online
The Establishment is not bound by the booking until it has accepted
it, subject to availability and, more generally, any natural circumstances
that may stop the Establishment from honouring the booking. The
Establishment reserves the right to refuse any booking that may
contravene its campsite rules or that may seek to divert it from its original
purpose.
Bookings accepted by the Establishment are personal and cannot be
transferred to a third party without the Establishment's prior approval.
3 – RATES
Accommodation is rented at the current rates, as shown on the back,
which are valid for 2019. They are stated in euros (€) inclusive of tax. Bare
site: The base rate includes one site for a tent, caravan or motorhome
for two (2) people, and access to the toilet block and campsite facilities.
Accommodation rental: Accommodation rentals include the equipment
listed under the description of the chosen accommodation option, and
the gas/electricity supply. The base rate is for two to eight (2-8) people,
according to the accommodation type. The Establishment reserves the
right to refuse access to groups that exceed the maximum capacity of
the rented accommodation.
4 – PAYMENT METHODS AND TERMS
he signed booking contract must be accompanied with a bank or postal
cheque, money order or ANCV holiday vouchers (intact with the top stub).
Bookings made more than thirty (30) days before the arrival date must
be accompanied by a deposit of thirty percent (30%) of the total cost of
the stay in order to be accepted. The remaining balance must be paid at
least thirty (30) days before the arrival date. If the remaining balance is
not paid by the Customer within eight (8) days of a request for payment
being sent by the Establishment, the booking will be deemed to be
cancelled and the deposit paid by the Customer will be retained by the
Establishment as compensation.
For bookings made less than thirty (30) days before the arrival date, full
payment must be made at the time of booking.
No booking will be accepted until the full price of the stay has been paid
to the Establishment.
5 – CCUPANCY TAX
This municipal tax is mandatory and is paid with the balance payable, at
the current rate at the time of payment (see the rates).
6 – BOND & INSPECTION
For accommodation rentals, a bond of two hundred and fifty euros
(€250) is required upon arrival to cover any cost incurred in returning the
accommodation to a good condition.
For payments by bank card, we place an authorisation hold on the card.
Upon arrival, the Establishment gives Customers an inventory form to
complete and hand to reception.
Upon departure, after emptying and cleaning the accommodation, an
exit inspection is performed with the Establishment's staff, depending
on the time of year. The bond is refunded to the Customer when no
damage or loss has occurred and when the accommodation is returned
in a spotless condition.
7 – BOOKING FEES
Booking fees may apply, depending on the booking method.
8 – GROUPS
A group is deemed to be when more than four (4) Accommodations are
booked by the same individual or by different individuals who know each
other and are travelling together for the same reasons and same dates.
In this situation, the Customer(s) must contact the Establishment prior
to booking.
9 – BOOKING CANCELLATIONS/AMENDMENTS
9-1. Amending the booking
Bookings may be amended by Customers, subject to the Establishment's
prior approval and the availability of the Accommodation for the
requested period.
9-2. Cancellation by the Establishment
Except in the event of a force majeure, if the Establishment cancels the
booking the Customer receives a full refund (rental, processing fee and
occupancy tax).
9-3. Cancellation, Delays & Interruption by Customer
If the Customer cancels the booking after the Establishment has
accepted it, for whatsoever reason excluding a force majeure event, the
amount paid with the booking is retained by the Establishment and
will not be refunded. To avoid this situation, Customers may take out
cancellation insurance (see 9-4).
Similarly, any interrupted or shortened stay (late arrival or early departure)
caused by the Customer will not give rise to any refund. If a Customer
is delayed and does not contact the Establishment within twenty-four
(24) hours of the arrival date stated on the contract, the Establishment
reserves the right to offer the Accommodation for rental again. The
Customer can no longer enjoy the booking or lodge any complaint.

9-4. Cancellation and interruption insurance
This insurance is optional. Customers have a choice whether or not to
take it out at the time of booking.
In the event that the stay is interrupted or cancelled, the insurance policy
pays out the full amount paid before arrival or the unused portion of the
stay calculated on a time-apportioned basis depending on the situation
(excluding processing fees and occupancy taxes). The insurance policy
is independent from the Establishment. Customers must notify the
insurance company of the claim within five (5) days of the event.
The cancellation and interruption insurance premium is 4% of the total
tax-inclusive booking cost, excluding processing fees, occupancy taxes
and other supplements. This premium must be paid in full at the time of
booking the stay, and is not refundable.
To claim the cancellation cover, you must inform the Establishment of the
reason for cancellation before midnight on the planned date of arrival.
All cancellations must be confirmed in writing.
10 – ARRIVAL/DEPARTURE
10-1. Arrival
On the first day of the booked stay, bare sites are available after 1pm and
rental accommodation after 3pm.
Customers must report to reception, where they will be given all the
information they need to set up on their site or take possession of their
accommodation.
10-2. Departure
On the departure date stated on the contract, the site/accommodation
must be vacated before 10am. Customers may be charged an extra day
in the event of a late departure.
An exit inspection may be performed by the Establishment's staff,
depending on the season. The pre-authorisation slip will be destroyed
or the bond refunded to the Customer, minus any compensation for
damage or losses noted in the accommodation or on the site, subject to
costs noted on supporting invoices. If the accommodation has not been
cleaned, the Establishment may retain the bond.
If the bond is retained, this does not exclude any further compensation
being demanded should the repair costs be greater than the bond
amount.
11 – LIABILITY/GUARANTEE
These general terms and conditions are subject to Articles 1709 et seq.
of the French Civil Code. Consequently, the Establishment is required to
provide the Customer with the booked Accommodation under the terms
stated in the contract. This guarantees the Customer exclusive use of the
Accommodation during the booked period.
12 – ESTABLISHMENT RULES
By confirming their booking, Customers confirm they have read the
Establishment's campsite rules. They agree to the terms of those rules
and acknowledge their binding nature. On behalf of themselves and
their assignees, they agree to comply with the terms of those rules. In the
event of a serious or repeated breach of those rules, the Establishment
may cancel the booking without compensation, as stated in the campsite
rules. In the event of a criminal offence, the Establishment may call on
the police and/or terminate the Customer's stay without compensation.
13 – TERMINATING THE CONTRACT
In the event that one or more of the parties to the obligations set out
in this document or those listed in the campsite rules breaches those
obligations, the booking may be terminated at the discretion of the
wronged party, who is responsible for providing proof of that breach.
14 – DATA PROTECTION
The Establishment will not send any of the information provided by
Customers at the time of booking to any third parties. That information
is confidential and will only be used by the Establishment's in-house
departments in order to process the Customer's order, and to personalise,
communicate and offer services available to the Establishment's
customers. In accordance with the French Data Protection Act (6 January
1978), Customers have the right to access, correct and dispute their
personal data. To exercise those rights, Customers need to send a written
request to the Establishment and state their full name and address.
15 – INTELLECTUAL PROPERTY
The content of the website www.seagreen-campings.com as well as
that of the Establishments' websites is the property of the Group and
its partners, and is protected by French and international intellectual
property laws. It is strictly prohibited to reproduce that content, in full or in
part, and any such reproduction may constitute an act of counterfeiting.
Furthermore, the Establishment retains ownership of all intellectual
property rights over the photographs, presentations, studies, drawings,
models, prototypes, etc. created (even at the Customer's request) with
a view to providing Services to the Customer. Therefore, Customers will
not reproduce or use the aforementioned studies, drawings, models,
prototypes, etc. without the express prior written consent of the
Establishment, who may require financial compensation in exchange.
16 – PRECONTRACTUAL INFORMATION & CUSTOMER ACCEPTANCE
By confirming their booking, Customers confirm they have received the
information they need, in accordance with Articles L. 111-1 et seq. of the
French Consumer Code, and waive their right to invoke any contradictory
document, which will be non-binding for the Establishment.
17 – WITHDRAWAL PERIOD
In accordance with Article L. 121-18-4° of the French Consumer Code,
Customers have no right of withdrawal.
18 – IMPORTANT NOTE
All brochures and websites are always susceptible to potential publishing
errors, mistakes and omissions. Please check the price at the time of
booking, as only the prices stated on your invoice are binding.
19 – DISPUTES
These T&Cs and any subsequent operations are governed by French law.
In the event of issues regarding the interpretation, validity or performance
of these T&Cs and of any related operation, and only after having
contacted the Establishment's customer service team, Customers may
refer the issue to a consumer ombudsman within a maximum timeframe
of one (1) year of the date of the written complaint sent by the Customer
to the Establishment by registered mail with confirmation of receipt.
