APPLICATION FIELDS
These general conditions of sale apply without restriction to all accommodation bookings and temporary locations made to Camping La Nouvelle Croze, operated by SARL LNC CAMPING, for its customers.
In accordance with Article L.113-3 of the French Consumer Code and the
the French Tourism Code, these general conditions are made available and communicated to any customer who is required, before the conclusion of any reservation, to read it under his sole responsibility.
The validation of the booking by the customer implies unrestricted acceptance of these terms and conditions of sale.
These general conditions of sale may be subject to subsequent amendments, the applicable version is the day of the conclusion of the reservation contract.
The details of the service provider are as follows : SARL LNC CAMPING, limited liability company with a capital of 10.000 Euros, registered at the PÉRIGUEUX RCS under the unique identification number 834.868.325, located in ROUFFIGNAC SAINT CERNIN (24580), and taken in the person of his Managing Director.
BOOKING
The customer makes the reservation of a pitch located in the campsite or accommodations as follows : either on the La Nouvelle Croze campsite's website available at www.lanouvellecroze.com ; or by telephone call confirmed by a writing (mail or postal) within 24 hours / days from receipt of the phone call.
It is the customer's responsibility to check the accuracy of the booking and to report any errors to Camping La Nouvelle Croze immediately.
The booking of a pitch or an accommodation will only be considered final after the customer has been sent the confirmation of acceptance of the booking by the La Nouvelle Croze campsite and after receipt of the full deposit and any fees whether for a remote sale that required or not, the establishment of a personalized estimate beforehand.
The accommodations (mobile-home) are only rented for the week, obligatorily over the period of the calendar from Saturday to the following Saturday, during the months of July and August. The pitches are rented by the night.
The SARL LNC CAMPING reserves the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order.
WITHDRAWAL
The legal provisions relating to the right of withdrawal in case of distance selling provided for by the French Consumer Code are not applicable to the provision of accommodation services, in accordance with the Article L.221-28 of the French Consumer Code.
PRICES
The accommodations and pitches offered by the campsite La Nouvelle Croze are provided at the rates posted at the campsite's headquarters, on its website lanouvellecroze.com or according to the estimate established by the service provider. They are all taxes included (french TVA). However, the mandatory tourist tax is not included in the price of the stay and must be paid by the customer once on the campsite. This tax is fixed by the local authorities and is entirely donated to the tourist office.
An eco-friendly contribution is applied on every booking, in order to carry out various awareness-raising and environmentally friendly projects. This contribution amounts is €0.25 per person over the age of 3 years old.
The options are charged extra, under the same conditions as the basic rates.
Fees are charged at the price of 18 Euros, applicable to each reservation, except in case of temporary commercial transaction in progress during the time of booking.
PAYMENT TERMS
PAYMENT OF DEPOSIT
The reservation will be final only after receipt of the deposit. For all reservations, the deposit corresponds to an amount of 25% per stay (except booking fees and cancellation option). For all last bookings within the 30 days before the beginning of the stay, the whole amount of the booking can be requested (deposit of 100%).
BALANCE
The price of the balance must be paid upon arrival of the customer in the campsite La Nouvelle Croze, at the beginning of his stay.
The LNC CAMPING company reserves the right, in case of non-compliance with the terms of payment and in particular the payment of the balance of the stay, to suspend or cancel the provision of accommodation services or the provision of a pitch reserved by the customer and / or suspend the execution of its own obligations. In this case, the La Nouvelle Croze campsite may receive benefits under the same conditions laid down in Article cancellation at the guest initiative».
PAYMENT OF A DEPOSIT
At the beginning of the customer's stay, upon arrival, a deposit of 200 Euros per bank imprint will be required with the client's signed authorization. In addition, a deposit of 90 Euros, pursuant to cleaning fee Will also be required.
The deposits will be returned at the end of the stay after inventory of the accommodation.
Refusal to grant a deposit in the aforementioned conditions may result in the suspension or cancellation of the provision of accommodation services or provision of a location reserved by the customer, without any compensation to the client. In this case, the La Nouvelle Croze campsite may receive benefits under the same conditions laid down in Article cancellation at the guest initiative».
METHODS OF PAYMENT
The payment of the deposit when booking the stay is possible by credit card, bank transfer or bank check to Camping La Nouvelle Croze».
Payment of the balance of the stay can be paid by cash, check, bank card or holiday vouchers (ANCV).
In case of payment by check, it must be issued by a bank domiciled in France or Monaco. The cashing of the check is made upon receipt.
CANCELLATION AT THE GUEST INITIATIVE
Any cancellation of a reservation to the customer's initiative will be carried out by email or post as soon as possible with the La Nouvelle Croze campsite.
Depending on the period in which the cancellation initiated by the guest is carried out, it will cause disruption of the campsite La Nouvelle Croze, the management of its booking and an impossibility, more or less important, to market the accommodation or the location that would be the subject of the cancellation.
Compensation will be collected by LNC CAMPING company who agrees to a limitation of the customer's liability as a result of its cancellation, under the following conditions :
- More than 30 days before the start date of the stay: the deposit will remain acquired at the campsite La Nouvelle Croze as a lump sum compensation but the amount of this deposit may be deducted from a reservation made within one (1) year from the said cancellation.
- Between 29 and 21 days from the start date of the stay: the deposit will be retained at the campsite La Nouvelle Croze as compensation, in addition to a lump sum compensation corresponding to 60% of the price of the stay excluding VAT.
- Between 20 and 7 days from the start date of the stay: the deposit will remain acquired at the campsite La Nouvelle Croze as compensation, in addition to a lump-sum compensation corresponding to 80% of the prix stay excluding VAT ;
- Within 7 days of the start date of the stay: the deposit will remain acquired at the campsite La Nouvelle Croze as compensation, in addition to a lump sum compensation corresponding to the entirety of the price of the stay excluding VAT.
Any interrupted or shortened stay (late-arrival, early-departure) by the customer will not allow any refund.
The LNC CAMPING company agrees to waive these lump-sum, limited and contractual indemnities, only for all customers who have subscribed to «the cancellation option» offered by the campsite La Nouvelle Croze.
CANCELLATION OPTION
The cancellation option is an optional contractual option that is incidental to the reservation of accommodation or location contract.
Its subscription by the customer and the realization of one of the conditions of its implementation will imply renunciation by the La Nouvelle Croze campsite of the indemnities that it is entitled to obtain to repair the damage resulting from the cancellation of the reservation by the customer.
The subscription to the cancellation option must be concomitant with the reservation of the accommodation or the pitch. The marketing of this offer to the customer ceases after confirmation of his reservation in the conditions provided in article booking.
This option is offered at flat rates of 34 Euros per week booked for accommodation and 14 Euros per week reserved for bare pitches.
In addition to the good collection of the price of the service, the LNC CAMPING company will waive its indemnities only in case of occurrence of one of the following events, and exhaustively listed, which would likely prevent the customer's arrival on the campsite :
- Medical event : serious illness, accident or death of the client, his spouse, his children or his parents.
The medical event must occur between the reservation and the beginning of the stay.
- Professional event : cancellation or modification of the dates of paid vacation of the client or his spouse by the employer and affecting the period of the stay; economic dismissal of the client or his spouse; transfer of the client or his spouse who would prevent the presence on the camping site for reserved dates.
The professional event must occur between the reservation and the beginning of the stay.
- Material event : serious incident affecting the client's principal residence (fire, explosion, water damage, theft or natural disaster) ; a serious accident affecting the vehicle and causing it to be immobilized.
The material event must occur no later than 48 hours before the start of the stay.
The cancellation option can not be applied when the event that occurred was known on the day of the reservation and subscription of this option.
For the implementation of this option, the customer will have to send by email or postal mail any element justifying the occurrence of one of the aforementioned events.
The application of the cancellation option entails the waiver by LNC CAMPING company of the indemnities strictly and exhaustively provided for in article «cancellation at the guest initiative» and does not in any way concern the return of the sums relating to the application fees and the subscription of the present «cancellation option» which remain acquired by the La Nouvelle Croze campsite.
The possible return of money collected, which were the subject of a contractual novation to become pay, is by La Nouvelle Croze campsite within 14 days crafted from the receipt of the required supporting documents, provided that they are deemed sufficiently convincing by the campsite.
ARRIVAL AND DEPARTURE OF CUSTOMERS
The allocation of a pitch or accommodation will be done on the day of the arrival of the client, in the best respect of its expectations with regard only to an obligation of means.
For accommodation (mobile-home), arrival must be from 15pm and departure before 10am. In the case of bare pitches, arrival must be from 12 noon and departure must be no later than 12 noon on the scheduled day.
The customer has the contractual obligation to warn the La Nouvelle Croze campsite, of his delay on arrival and outside reception hours, by any means at his convenience.
Beyond a delay of 24 hours from the time of arrival on the booking contract, and without the customer having previously notified the La Nouvelle Croze campsite, the company reserves the right to no longer
accept the client and no refund will be made by the campsite La Nouvelle Croze which will retain any amounts already collected as compensation and may require payment of a lump sum under the same conditions laid down in Article cancellation at the guest initiative.
In addition, no refund will be made in proportion to the time during which the accommodation or pitch would not be used by the customer.
In case of early departure of the customer in relation to the dates and times specified in the booking contract, no refund will be made. In this case, the cancellation option is not applicable and is totally excluded.
ASSIGNMENT OF RESERVATION
In accordance with Articles L.211-1 and 1 R.211- 7 of the French Tourism Code, the customer can transfer his contract to a third party, subject to inform the La Nouvelle Croze campsite later than 7 days before the start the stay, stating the name and address of the transferee. The assignee will be deemed to have read the terms and conditions of sale.
RULES OF PROCEDURE
The client must comply with the rules of the La Nouvelle Croze campsite, which he can see at any time and at the latest, on arrival at the scene.
VARIOUS BENEFITS
Pets are allowed in the campsite provided they are on a leash, tattooed and vaccinated. Pets are charged a fee of 6.50 Euros per night for accommodation and 1.50 Euros for pitches.
The cleaning package offered to the client does not correspond to a full household of the accommodation, so that a partial cleaning will have to be done by the customer before his departure.
The potential visitors invited by their campers hosts are allowed to access all the services of the campsite, after having paid the « visitor's fee » set at the daily price of 7.00 Euros.
PROTECTION OF PERSONAL DATA
The LNC CAMPING company considers as « personal data » any information allowing to identify the customer and his stay at the La Nouvelle Croze campsite.
The collection of this information, during the booking of the accommodation or the pitch, is essential to the execution of the obligation of the campsite. The refusal to consent to the processing of personal data would prevent the execution of the service.
LNC CAMPING who collects the information is responsible for its treatment and is committed to ensuring the technical protection and confidentiality of the data.
LNC CAMPING does not transmit any personal information or any contractual information, in any way whatsoever, to third parties.
In accordance with EU Regulation 2016/679 (RGPD), the customer has a right to access, modify, rectify and delete data concerning him, by contacting the La Nouvelle Croze campsite by email : contact@lanouvellecroze.com.
Any claim must be lodged by the client with the CNIL.
APPLICABLE LAW - DISPUTES
The present general conditions of sale and the operations which result from it between LNC CAMPING and the customer are subjected to the French right. The original general conditions of sale are written in French. In the case where they are translated into one or more foreign languages, only the French text will prevail in case of dispute.
Any dispute relating to their interpretation and execution is submitted to the competent courts under common law conditions. However, in the event that a reservation is made by a merchant, the dispute will be brought before the Commercial Court of PÉRIGUEUX in accordance with Article 48 of the Code of Civil Procedure.
The customer is informed, in accordance with Article L.211-3 of the French Consumer Code, that he can in any case resort to a conventional mediation, in particular from the Consumer Mediation Commission or from existing sectoral mediations, or any alternative dispute resolution process.
ACCEPTANCE OF THE CLIENT
The customer acknowledges having communicated, before any reservation, in a clear and understandable manner, these general conditions of sale and all the information listed in Article L.221-5 of the French Consumer Code.
The fact for any person to make a reservation carries adhesion and full acceptance of the present general conditions of sale and obligation to the payment of the services, which is expressly recognized by the customer who gives up to invoke any contradictory document which would be inopposable at the La Nouvelle Croze campsite.
