The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in the context of the rental of camping pitches and/or rental accommodation within our campsite.
By reserving a pitch and/or accommodation on our campsite, you acknowledge that you have read and accepted these General Terms and Conditions.
Article 1 - Services and rates
We offer bare pitches and rental accommodation for rent.
1.1 Bare pitches
This is a bare pitch for your tent, caravan or motor home.
The price of your stay is calculated on the basis of a basic package which includes the rental of the pitch, the possibility for 1 or 2 persons to stay there, the possibility to install 1 tent, 1 caravan or 1 camper van, 1 vehicle in addition to the tent or caravan and access to the reception facilities, to the entertainment and sanitary facilities, a connection to the electricity network.
Additional costs (extra person, electricity (for certain pitches), extra vehicle, pets, fridge, wifi, etc.) are not included in the above packages and will be added to the latter.

1.2 Rental accommodation
Our prices include the rental of the accommodation according to the number of people (depending on the capacity of the accommodation), water, gas and electricity charges (in a fixed price), parking for one vehicle, access to the reception facilities, entertainment and sanitary facilities. A deposit of maximum 500 € will be requested following your reservation OR on your arrival, which will be returned to you at the end of your stay and at the latest within a week by post from your departure. However, we reserve the right to retain part or all of it in the event of damage to the accommodation and/or its contents and/or equipment on the campsite. We also reserve the right to deduct the sum of 65 € for cleaning costs if this has not been carried out on departure.

1.3 Common provisions
The prices indicated are inclusive of all taxes and do not include the tourist tax.
Regardless of the type of accommodation (bare pitch or rental accommodation), additional costs will be charged for extra vehicles, extra tents, animals, visitors, etc.
No brochure or website can be guaranteed to be free from omissions or printing errors. Our prices are subject to change according to economic and commercial conditions. The contractual price, due by you, is the one stated on your booking confirmation.

Article 2 - Booking conditions
2.1 Reservation methods
You can make a reservation on our website www.campingolivigne.fr, the website www.flowercampings.com, by telephone, by e-mail or at the reception. All reservation requests must be accompanied by :
- payment of a 30% deposit including the cost of the stay, the price of the services booked including VAT and, if applicable, the tourist tax,
- the booking fees are free of charge, except for certain specific requests, which may amount to 25 €.
- and the contribution for the cancellation insurance (if subscribed).
The reservation made is only contractually binding on receipt by you of a written confirmation of reservation, by e-mail, summarising all the information relating to your stay.
The balance of the price of the stay, including the price of the services booked and, if applicable, the tourist tax, must be paid at the latest 30 days before the start of the stay. If the balance is not paid within the above-mentioned period, the stay is considered as cancelled and our cancellation conditions described below apply.
Any reservation made less than 30 days before the date of arrival must be paid in full at the time of booking, unless you are informed of more favourable conditions.

2.2 Right of withdrawal
According to article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or at a specific time.
2.3 Maximum capacity
For safety and insurance reasons, the number of occupants may not exceed the capacity provided for by the type of accommodation or pitch booked (1 to 6 people maximum, depending on the capacity of the accommodation or pitch), including newborns. If we observe on arrival that the maximum capacity of the accommodation or pitch reserved is exceeded, we reserve the right to refuse you access to the accommodation or pitch reserved, without reimbursement of the price of your stay by us.

2.4 Customers - Minors
For safety reasons, minors who are not accompanied by their parents or grandparents for the duration of their stay are not accepted on our campsite, unless we have notified you of this prior to your arrival, by e-mail, on your request.
Article 3 - Payment methods
3.1 Accepted methods of payment
You can pay for your booking or your stay by the following methods: holiday cheque, cash, bank card, bank transfer, secure online payment. However, by way of derogation, bookings made less than 30 days before the start of the stay must be paid by credit card only.
3.2 Visiting guests
For stays on a pitch without a reservation (transient), you must pay at least the first night on arrival. You are also responsible for informing reception of the desired or extended length of stay. The balance must be paid at the latest on the day before departure, taking into account the opening hours of the reception. In case of advance payment and early departure, no refund will be made.
Article 4 - Stay
4.1 Handover of keys
Arrivals are between 3.30 p.m. and 8 p.m. in high season and between 4 p.m. and 7 p.m. in mid season. Departures must be made before 10 am, any day of the week. Your wishes for a specific pitch or accommodation on the campsite can only be fulfilled if we are able to accommodate you on arrival.
Your accommodation must be left in the same condition as it was when you left; in particular, you must have cleaned it yourself. 
4.2 Late arrival and early departure
In the event of late arrival or early departure with respect to the dates mentioned on your booking confirmation, the total amount of the stay will remain due. You will not be entitled to any reimbursement for the part of the stay not taken.

4.3 Animals
Dogs and cats, except category 1 and 2 dogs, are allowed on our campsite. We require that dogs are kept on a lead within the campsite. Please respect the hygiene and environment of the campsite. The health booklet must be presented on arrival at the campsite. Anti-rabies vaccinations and a tattoo certificate are compulsory. Animals are strictly forbidden in the sanitary facilities, in the reception area and in the swimming pool.

4.4 House rules
During your stay, you must respect the campsite's internal regulations (a copy of which is also posted at the reception). We will be happy to send you a copy by e-mail on request.
4.5 Image
During your stay, we may take photographs and/or make videos within the campsite for the purposes of entertainment and/or communication in which you and the persons accompanying you may appear. By making a reservation, you are presumed to authorise us to use the photos and/or videos in which you appear for the above-mentioned purposes. You also guarantee this authorisation by the persons accompanying you. Any specific refusal must be notified to us by email or registered letter with acknowledgement of receipt.

4.6 Unavailability of certain services
One or more of the services we offer (non-exhaustive list): swimming pool, snack bar in the Minervois hall, technical incident, activities, entertainment, children's club, etc. may be temporarily unavailable during all or part of your stay. We cannot be held responsible in this respect; no refund of price, partial or total, will be made as a result.

4.7 Cancellation of the booking contract in the event of a fault on your part
The booking contract will be automatically terminated in the event of one or other of the following events occurring:
- In the event of repeated non-compliance, i.e. again after a formal notice to comply notified by e-mail, by you and/or your companions with our internal regulations.
- In this case, you will have to leave your accommodation or pitch within 2 hours of the cancellation of your contract, which will be notified to you by e-mail. No refund will be made by us,
- If you do not show up at the campsite within 24 hours of the start of your stay and do not provide proof of your arrival and/or news of your arrival.
We will dispose of your accommodation at the end of the aforementioned 24-hour period. We shall retain all the sums you have paid to us, if applicable; no refund shall be made.
Article 5 - Change of stay
You may request to change the dates and/or terms (type of accommodation) of your stay at our campsite, provided that your request reaches us by e-mail at least 21 days before the initial date of arrival.
However, you will have to book a new stay at our campsite during the same season as the one in which the initial stay was planned, according to the availability and prices in force. Your initial stay can only be changed once. If you are unable to honour the substitute holiday, it will be considered as cancelled; the sums paid will not be refunded.
If the price of the substituted stay is higher than that of the initial stay, you must pay the difference no later than 30 days before the new arrival date. If you fail to do so, the substituted holiday is considered to be cancelled and our cancellation conditions described below will apply. If the price of the substituted holiday is lower than the price of the original holiday, we shall retain the difference in price as compensation for the loss resulting from the change of holiday.
Article 6 - Cancellation of stay
6.1 Cancellation by you
All cancellations must be notified to us by e-mail or registered letter with acknowledgement of receipt; they will take effect on the date of their first presentation by the postal services:
- If your e-mail/courier is presented more than 30 days before your arrival, the amount of the deposit paid, the booking fees paid and, if applicable, the sums paid for cancellation insurance shall be retained by the campsite.
- If your letter is presented between the 30th and the 15th day before your arrival, the deposit and the booking fees paid at the time of booking, and, if applicable, the sums paid for cancellation insurance at the time of booking, shall be retained by the campsite; the balance of the price of the stay shall be the subject of a credit note to be used for a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season.
- If you have booked your stay less than 30 days before the date of your arrival, and your cancellation letter is presented 15 days or more before this date, the sums corresponding to the amount of the deposit, the booking fees and the contribution linked to any cancellation insurance taken out, as referred to in article 2 of these GTCs, will be retained by the campsite; the remainder will be the subject of a credit note to be used for a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season.
- If your letter is presented less than 15 days before the date of arrival, the total amount paid to the campsite will be retained.
In order to obtain compensation, we advise you to take out cancellation or interruption insurance when you make your reservation.
As an exception to the above, if your cancellation is due to the fact that you live in an area where a confinement measure prohibiting people living there from moving around to avoid the spread of Covid 19 is in force on the date of the start of your stay, the amount of the deposit paid, the booking fees paid and, if applicable, the sums paid for cancellation insurance shall be retained by the campsite; the surplus will be the subject of a credit note to be used for a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season. This applies even if your cancellation letter is presented to us less than 15 days before the start of your stay.

6.2 Cancellation by the campsite
If we have to cancel a reservation that we have confirmed to you, we will inform you as soon as possible by e-mail; the sums paid will be refunded in full.

By way of derogation, if our cancellation is the result of an administrative closure imposed in particular to combat the spread of Covid 19, or any other major event, the sums paid will be retained by us and will be the subject of a credit note to be used for a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season

Article 7 - Complaints about a stay

Any complaint relating to a stay must be made in writing and sent to us by registered letter with acknowledgement of receipt within 20 days of the end of the stay.
In the event of a dispute and if no amicable solution is found within one month of receipt of the aforementioned letter of complaint, you may have recourse free of charge to a consumer ombudsman, provided that you refer the matter to him within one year of sending your letter of complaint. By default, we suggest you use the following consumer mediator:

Article 8 - Personal data

When you make a reservation or during your stay, some of your personal data may be collected and processed by us.
When a reservation is made by telephone, in reception, on our website www.campingolivigne.fr or on the website www.flowercampings.com, the methods of processing the data collected prior to or at the same time as the reservation are the subject of the confidentiality policy or the general conditions of sale that you accept before confirming the reservation.
The personal data collected during a reservation made by telephone or during your stay are the following
- Name and surname of the person who made the booking,
- Telephone number of the person who made the reservation,
- Email address of the person who made the reservation
- Date of birth of the person who made the reservation and of the accompanying persons
This data is collected and processed on the following basis:
- Your consent,
- The need to enable the performance of a booking contract between us.
No one other than us and the company Flower (Société par Actions Simplifiée with a capital of 92 500 €, registered in the Toulouse Trade and Companies Register under number 492 355 508, with its registered office at Les Espaces de Balma 4-5, 16 avenue Charles de Gaulle, 31130 BALMA) has access to the data collected. The data collected is processed for the following purposes
- The execution of a reservation contract concluded between us;
- The management of your possible complaints,
- The keeping of our customer file,
- The carrying out of commercial prospecting by us and/or the company Flower,
- The management of our accounts.
The data collected will be kept for 5 years following the end of the stay for the other data, except in the event of a dispute not settled at the end of this period, in which case the data will be kept until the end of the dispute.
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, it is specified that each person has the following rights with regard to their data: right of access, right of rectification, right to erasure (right to be forgotten), right of opposition, right to limit processing, right to portability. Each person may also define directives relating to the conservation, erasure and communication of his/her personal data after his/her death. Each person may, on grounds relating to his or her particular situation, object to the processing of data concerning him or her.

Any person who is the victim of a breach of one of the above-mentioned rights may lodge a complaint with the CNIL (https://www.cnil.fr/).


INTERNAL REGULATIONS AND SAFETY INSTRUCTIONS

Prerequisite
We are pleased to welcome you to our establishment and we wish you a very pleasant stay. You can be sure that the campsite team will do its utmost to ensure that your holiday is as comfortable, friendly, clean, respectful and safe as possible. As a customer, you are a major contributor to the achievement of these objectives. That is why staying at the campsite implies acceptance of these rules, the safety instructions and the obligation to comply with them. As the campsite management is the guarantor of order, it is entitled to take all necessary measures - including recourse to the police and the courts - to enforce these rules and regulations. It can demand reparations, damages and, if necessary, the expulsion of persons and their equipment.
Practical elements:
- Before setting up :
o It is imperative that all participants in the stay can prove their identity with a legal and valid document
o Animals are tolerated for a fee and a legal and valid vaccination booklet. They must be kept on a leash and must never be left alone
- The installation of your camping equipment and vehicle is limited to the pitch indicated by the campsite staff. Your pitch must be kept clean and tidy at all times. The display of laundry is tolerated if it is discreet. The vegetation and all facilities must be respected
- The speed limit inside the campsite is 10km/h
- The reception is open (at least)
o Off season: from 9am to 11.30am and from 3.30pm to 7pm
o July and August: from 8.30am to 12pm and 3pm to 7.30pm
- The automatic barrier is closed between 7.30am and 11pm. No vehicles are allowed to circulate during these closing hours inside the site where calm is imperative
- The duration of stays is limited to three months. Beyond this period, the Management reserves the right to extend the stay or not
- Household waste must be sorted, bagged and deposited in the containers to the left of the entrance
- The charges (invoices) are to be paid on arrival, as stated in our GTC. The amount is fixed (incl. VAT) and according to the displayed tariff. On the day of departure, the pitch and/or rental unit must be clean and vacated by 10.00 am at the latest. Cleaning may be charged in accordance with the price list displayed at reception.
- Visitors are required to leave their vehicles outside the campsite and to report to the campsite staff
- Vehicles parked outside the campsite must leave the way for the emergency services and not park in front of the campsite signs
- Washing of any type of vehicle (caravan, car, motor home, bicycle, etc.) is forbidden
- Children under the age of 3 are under the continuous supervision of their parents
- The playground is reserved for children from 5 to 12 years old, under the continuous supervision of their parents
- The swimming pool is an unsupervised natural (bio-mineral) bathing area, authorised for children under the full responsibility of their parents. Showering before swimming is compulsory
Theft and damage
- The campsite management is in no way responsible for any theft or damage to your belongings
- The public areas, entrance/exit points and buildings are under video surveillance. Any damage, theft, incidents (brawl, night-time disturbance), etc. will be reported immediately to the police.
- For all rentals a deposit of maximum 500 € is required. Any damage, breakage, dirt, deterioration will be charged to the tenant. On arrival, it is advisable to check the condition of the rental property and to report any shortcomings or damage to the campsite staff.
- For the loan of equipment (barbecue grill, electric extension, ice bread, plancha, etc.) a deposit is required: in the event of non-return, damage, breakage, dirtiness, the totality of this deposit will not be returned
Living together
- It is forbidden to leave any type of waste on the ground or to empty your waste water on the ground. For animals, a dispenser of disposable bags is at your disposal near the reception as well as an outside shower.
- Calm and silence are required throughout the day and in particular between 10.30 pm and 7 am. During these hours, vehicle traffic, music, collective games (pétanque, ball, etc.) are prohibited.
- In the event of any incident, conflict or discontent, the campsite management must be informed in order to try to find solutions in the interest of all.
- Violent games, disrespect, acts of discrimination, insults, abuse (non-exhaustive list) are forbidden and will be subject to expulsion
- The sanitary facilities must be kept clean and hygienic. Squeegees, brushes and bins are available to users. Black water, chemical toilet cassettes, chamber pots, etc. must only be poured into the chemical waste bin on the camper van site (opposite the reception)
Safety
- In the event of a fire, immediately notify the management and/or the fire brigade (112)
- Fire extinguishers are at your disposal in the sanitary facilities. It is forbidden to try to open the electrical boxes
- Take precautions when using gas, electrical appliances, stoves, extension cords, etc. Any anomaly found or not confirmed will lead to a ban on use
- It is strictly forbidden to crush and throw cigarette butts on the ground. Please extinguish them before putting them in your rubbish bin
- All types of fires (coal, wood, gas) are strictly forbidden.
- It is forbidden to have more than 2 gas bottles of 3 kilos in the tents.
Safety instructions to be respected imperatively:
In case of evacuation of the campsite, please respect the following safety instructions and follow the instructions given by the campsite staff or the emergency services. The evacuation plans are posted:
- In the sanitary block
- At the reception building
In case of evacuation, you will be alerted by :
- A continuous siren, a whistle or a megaphone
- The campsite staff
- The police and/or the emergency services
Then, the instructions to be followed are as follows:
1.Keep calm
2.Take the bare necessities with you: identity papers, money, valuables
3.The competent personnel will inform you if you can take your vehicle and/or your equipment. Under no circumstances should you obstruct paths, tracks and/or emergency accesses
4.Follow the escape route, following the arrows (evacuation, exit and/or emergency exit).
5.Go to the pre-assembly area, which is the motorhome service area, opposite the campsite reception.
